BaseSense supports wellness organization. It never replaces medical care or emergency services.
1. Agreement to these Terms
These Terms of Use (“Terms”) are a binding agreement between you and BaseSense governing the BaseSense website, mobile application, early-access program, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility and accounts
You must be at least 13 years old and legally able to agree to these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you.
- Provide accurate account information and keep it current.
- Protect your credentials and do not share access to your account.
- Notify support@basesense.app promptly if you suspect unauthorized access.
- You are responsible for activity performed through your account unless prohibited by law.
3. Medical and emergency disclaimer
BaseSense is a wellness and information-organization tool. It does not provide medical advice and is not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition. Content, trends, baselines, reminders, and automated observations may be incomplete or incorrect and are not a substitute for a qualified healthcare professional’s judgment.
Do not use the Services for emergencies or time-sensitive medical decisions. If you think you may have a medical emergency, contact local emergency services immediately. Never disregard professional medical advice, delay seeking care, or change medication or treatment because of information shown by BaseSense.
4. Permission to use the Services
Subject to these Terms, BaseSense grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for lawful personal wellness and informational purposes.
5. Acceptable use
You may not misuse the Services or help anyone else do so.
- Violate law or another person’s privacy, intellectual-property, or other rights.
- Access another person’s account or submit information about another person without authorization.
- Reverse engineer, scrape, probe, disrupt, or bypass security or access controls except where law expressly permits it.
- Introduce malware, automate abusive requests, or interfere with the Services or their users.
- Use the Services to provide medical care, make automated high-impact decisions, or create a competing dataset or service without written permission.
6. Your content and feedback
You retain ownership of information and content you submit (“Your Content”). You grant BaseSense a limited license to host, process, reproduce, and display Your Content only as needed to operate, secure, and improve the Services and fulfill your requests. This license ends when Your Content is deleted, except for protected backups and records we must retain.
If you voluntarily provide product feedback, you allow us to use it without restriction or compensation, but this does not give us ownership of your private health entries.
7. Third-party services
The Services may link to or integrate with third-party products. Their terms and privacy practices govern your use of those products. BaseSense does not control and is not responsible for third-party services, data accuracy, availability, or conduct.
8. Early-access and changing features
Pre-release features may be incomplete, unavailable, or changed without notice and may contain errors. We may add, remove, suspend, or discontinue features or the Services. Roadmaps and descriptions of planned functionality are directional and are not promises of delivery.
9. Fees and subscriptions
If paid features become available, pricing, subscription duration, billing frequency, features included, renewal terms, and cancellation options will be clearly shown before purchase. Digital features purchased in the iOS app will use Apple’s In-App Purchase system where required. Auto-renewable subscriptions continue until canceled and provide ongoing access for the disclosed subscription period.
You can manage or cancel an App Store subscription in your Apple Account subscription settings. Deleting your BaseSense account does not automatically cancel billing through Apple. Purchases, cancellations, and refund requests are also subject to Apple’s applicable terms and processes. BaseSense will not reduce rights that cannot legally be waived.
10. BaseSense property
The Services—including software, designs, text, graphics, branding, and other materials excluding Your Content—are owned by BaseSense or its licensors and protected by intellectual-property laws. No rights are granted except the limited permission expressly stated in these Terms.
11. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or if the Services are discontinued. Where practical, we will provide notice and an opportunity to export Your Content. Provisions that by their nature should survive termination will survive.
12. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” BaseSense disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and that the Services will be uninterrupted or error-free. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, BaseSense and its affiliates, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from the Services. BaseSense’s total liability for claims relating to the Services will not exceed the greater of $100 or the amount you paid BaseSense in the 12 months before the event giving rise to the claim. These limitations do not apply where prohibited by law.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless BaseSense and its affiliates and personnel from third-party claims arising from your unlawful misuse of the Services, Your Content, or your material violation of these Terms. This obligation does not apply to the extent a claim results from BaseSense’s own conduct.
15. Apple App Store terms
If you obtain the app through Apple’s App Store, Apple is not a party to these Terms and is not responsible for the app or its support, maintenance, warranties, or claims relating to the app. Apple and its subsidiaries are intended third-party beneficiaries of this section and may enforce it against you. Your use of the app must also comply with the App Store Terms of Service and applicable usage rules.
Unless a custom end-user license agreement is presented in App Store Connect, Apple’s Standard Licensed Application End User License Agreement applies to the licensed iOS application. Nothing in these Terms limits obligations or consumer rights imposed by Apple’s applicable terms or law.
16. General terms
These Terms and the Privacy Policy form the entire agreement concerning the Services unless additional terms are presented for a specific feature. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a business reorganization or by operation of law.
17. Changes and contact
We may revise these Terms as the Services evolve. We will post updated Terms with a new effective date and provide additional notice when required. Continued use after revised Terms take effect means you accept them. Questions can be sent to legal@basesense.app or support@basesense.app.
